As a condition of and in consideration for the opportunity to participate in social and recreational sports activities ("Activities") offered, organized, sponsored, and/or hosted by Play Recess, I, for myself and any of my heirs, personal representatives, executors, administrators, or assigns, do hereby release, discharge and covenant not to sue Play Recess, its employees, principals, agents and volunteers (the "Releasees") from all liability and waive any claim for damages arising from any cause whatsoever, except those damages resulting from Releasees' gross negligence. EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY. In recognition of the risks inherent in the Activities in which I will engage, I confirm that I am physically and mentally capable of participating in those Activities and using any equipment that may be required in connection with those Activities. I am participating in the Activities willingly and voluntarily. I assume full responsibility for torn muscles, fractures, wounds, cuts, abrasions and/or contusions, head, neck, and/or spinal injuries, bites, attacks by animals or insects, allergic reactions, shock, paralysis, coma or death, and any expenses that are related to such injuries sustained by me. I also assume full responsibility for damage to or loss of my personal property that may occur during Play Recess Activities or otherwise. INDEMNITY & HOLD HARMLESS AGREEMENT. I agree that I will indemnify and hold harmless Play Recess, its employees, principals, agents and volunteers (the "Indemnitiees") from any loss or liability and waive any claim for damages or costs against them arising from any cause whatsoever related to my participation in Play Recess Activities, except that which is the result of the Indemnitees' gross negligence. I agree to indemnify and hold harmless the Indemnitees with the knowledge that my agreement encompasses any and all claims arising from damages and/or injuries caused to me as well as any and all claims arising from damages and/or injuries caused by me. SCOPE OF PARTICIPANT AGREEMENT AND RELEASE. I agree that this Participant Agreement and Release is intended to be as broad and inclusive as is permitted by the laws of the State of California. I further agree that, if any portion of this Agreement is held invalid, the remaining portions shall remain and continue in full force and effect. I understand that this is a full and final release applying to all unknown and unanticipated damages arising in connection with my participation in Play Recess Activities, as well as to those now known or disclosed, and I waive all rights and benefits that I now possess or in the future may acquired under the terms of Section 1542 of the Civil Code of the State of California, which provides: "A general release does not extend to the claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." MEDICAL INSURANCE COVERAGE. I understand that neither Play Recess nor any of its employees, principals, agents or volunteers shall be required (1) to ensure that any participant's health insurance coverage is valid and/or in force or (2) to confirm the validity of any participant's personal identification. I further understand that it is my responsibility to maintain health insurance covering any injury that I may receive while traveling to, participating in, and/or returning from any Play Recess Activities.
